1. Definition and subject matter of the Contract

1.1 This contract, now referred to as "Contract", is a distance Contract regulated under the Consumer Code. The subject matter of this Contract is the sale of furniture between GRUPPO ADV Srl, with registered office in Osnago (LC), Via Galvani 16, Fiscal Code/VAT Registration Number 02692630136 and Reg. of Companies of Lecco n. 02692630136 and with headquarters in Osnago (LC), Via Resegone 10, now referred to as "TavoliSedie", and the buyer now referred to as the "Customer". The Contract the contract is concluded directly through the acceptance by TavoliSedie of a purchase proposal issued by the Customer by telephone or via the Internet, following the invitation to offer content on the website www.tavolisedie.com now referred to as the "Website" and/or through other remote sales systems of TavoliSedie, as described in Article 3 below.

1.2 The present general conditions now referred to as "General Conditions" and, in particular, the information of the Consumer Code as supplied by the TavoliSedie to the Customer by phone, email and reported on the Website, will remain valid and effective until it is modified and/or integrated by TavoliSedie. Any changes and/or additions to the General Conditions will be effective from the date on which they are communicated to the public and will apply to sales made from that date. The latest updated version of the General Conditions is the one available on the Website.

2. Prices

The selling prices of the products illustrated, on the Website and/or through any other distance selling system of TavoliSedie are to be understood as including VAT. For purchases made by all people resident in the Italian territory, the VAT in force will be applied to the sale price. For purchases made by any individual holders of a VAT number, resident in the territory of the European Community with the exception of Italy, VAT will not be applied because they are considered non-taxable transactions in accordance with the laws in force. for purchases by any person not resident in the Italian territory and in the European Community, VAT will not be applied, as they are considered non-taxable transactions under the laws in force.

Delivery costs are always borne by the Customer and they are indicated on the Website and/or through other distance selling systems of TavoliSedie and, in case of order placed by phone, repeated to the Customer by the operator of TavoliSedie, will be automatically calculated by the system at the time before payment.

Deliveries outside Italy or in Italian territory to be reached through the passage of customs barriers (ex. Not exhaustive: Campione d’Italia, Livigno and so on) may be subject to taxes and customs duties when entering the Country; they cannot be calculated in advance because they vary from country to country. Please contact your local customs authority for detailed information. This share, to be paid by the consignee, is collected, where present, by the carrier in charge of delivery.

3. Terms of purchase and payment

3.1 – In case of purchase proposals made by phone by the Client (who has contacted TavoliSedie by phone and formulated, on that occasion, a purchase proposal, providing to the operator the data necessary to the procedure of registration of his name, purchase order and payment method chosen), the same Client will receive by TavoliSedie a summary email, with which he will be informed that his purchase proposal is being processed and will be deemed accepted, unless otherwise communicated by email or telephone transmitted by TavoliSedie within 3 (three) calendar days of receipt of the summary email. After this term, the Internet Contract is to be considered completed.

3.2 - In case of purchase proposals sent via the Website, the Client will receive by TavoliSedie a summary email with which he will be informed that his purchase proposal is being processed and will be deemed accepted, unless otherwise communicated by email or telephone transmitted by TavoliSedie within 3 (three) calendar days of receipt of the summary email. After this term, the Contract via the Internet is to be considered completed.

3.3 – The Client can choose one of the following payment methods:

(a) through Pay Pal circuit (with credit card, prepaid credit card, Poste Pay or current account);

(b) through Bank Transfer.

3.4 – For the payment through credit card, prepaid credit card, Poste Pay or current account, TavoliSedie relies on PayPal to allow its clients to buy safely. The client who choose to pay though this method is redirected to the page of PayPal payment for entering confidential data.

If the Client does not already have a PayPal account, he can create a new one free on the site www.paypal.it.

3.5 – For the payment through Bank Transfer, the coordinates will be sent at the time of order.

To avoid misunderstandings and speed up order processing, it is essential that the description column of payment the order number must be indicated.

4. Delivery of products - complaints

4.1 - TavoliSedie delivers the products to the address indicated by the Customer approximately within a period of time from 30 to 40 days from the conclusion of the Contract.

4.2 - TavoliSedie s.r.l. uses only express couriers for both national and international deliveries, in order to guarantee the highest quality of service.

4.3 – To prevent delivery problems from occurring (absence of the consegnee, not available at the address and so on...) it is essential to provide precise and complete indications (for ex. to leave the package in the concierge's desk, exact name on the entry phonedifferent from the name of the person who orders the good, , any neighbours willing to pick up the goods, and so on.). It is, however, a good idea to always leave a telephone number to be easily contacted. It is necessary to indicate any traffic restrictions provided for those who live in historic centres and in areas with limited traffic: in these cases, the good will be delivered at the times allowed by municipal regulations. If, at the moment of the delivery by the Courier no one is present to receive the good TavoliSedie, is authorized to contact the Client to arrange a new appointment for delivery, for which will be debited additional amounts related to the costs of storage and delivery costs of euro 50.00 (fifty) to be paid directly to the carrier on delivery. The data entered in the orders will not be disclosed and will be used exclusively by TavoliSedie for the completion of deliveries.

4.4 - Deliveries are strictly made only to the street level in front of the house destination number of the goods. Deliveries on reservation of the day and time, to single houses or at the floor of the condominium can be made only previous agreement on time and surcharge of the operation, to be specified in the notes when ordering. The payment will then be made and then the customer will be contacted by email by TavoliSedie communicating the specifications of time and surcharge. If the Client will accept the specifications with communication via email to the address assistenza@tavolisedie.com, the good will be delivered, otherwise the order will be cancelled and TavoliSedie will pay back the amount paid by the Client al the moment of ordering. It is necessary to indicate any traffic restrictions provided for those who live in historic centres and in areas with limited traffic: in these cases, the good will be delivered at the times allowed by municipal regulations If, at the moment of the delivery by the Courier, no one is there to receive the goods for 2 consecutive attempts, the Courier will keep the goods in stock at its warehouses charging the amount of euro 26.90 (twenty-six/90) to be paid directly to the carrier in cash on delivery for the opening practice and the new attempt at delivery, for which TavoliSedie is authorized to contact the Client to arrange the new appointment for delivery. The Courier will keep the goods in stock charging euro 0.55 (zero/55) VAT excluded per quintal per day, with a minimum daily fee of euro 3.10 (three/10) VAT excluded. The goods will be in stock for a maximum of 10 days after which they will return to the warehouses of TavoliSedie. Then, after seven days, the order will be cancelled and will be refunded to the Client the amount paid net of expenses as incurred above with the addition of euro 50.00 (fifty) VAT excluded for the initial shipping costs and handling cancellation practice.

4.5 – At the time of delivery, the Client, the customer undertakes to verify the effective integrity of the packages and that they are not open, wet, damaged or in any way tampered with or damaged.

For any problems occurred sign with RECEIVED WITH RESERVE and describe the reason directly on the delivery note.

We remind you that in case of signature without contesting any obvious damage, the carrier will be relieved of any liability for damage occurring during transport.

TavoliSedie is relieved, of its burden on the purchaser, in the cases of missed or delayed delivery, even partial, for reasons beyond its control, fortuitous events and in all cases attributable to the responsibility of the carrier.

5. Guarantees and assistance

5.1 – For the products purchased by the Client the rules on guarantees and assistance relating to the sale of consumer goods apply to TavoliSedie.

5.2 All products are guaranteed for a period of time with respect to the regulations in force in relation to the type of Client, whether he is a natural person or a legal person, from the date of purchase against any manufacturing defect. In case of proved product failure, the guarantee consists in the replacement or repair of the latter. Damage caused by misuse or tampering with the product is not guaranteed.; in such cases TavoliSedie assumes no responsibility for direct or indirect damages deriving from such behaviour. Moreover, TavoliSedie assumes no responsibility for direct or indirect damages to persons or things as a result of the malfunctioning of the products. The purchase order by the Client is the factual confirmation of the integral acceptance of the sale conditions.

5.3 - TavoliSedie undertakes to deliver to the customer an object conforms to the model and layout described in the Contract and in the commercial documentation prepared by TavoliSedie. Modifications to the object made by TavoliSedie and aimed to improve the quality and safety of the product do not do not constitute failure to fulfil obligations by TavoliSedie if not communicated to the Client. TavoliSedie also reserves the right to make aesthetic and functional changes to the dimensions or structure of objects as suggested by technical requirements, without prior notice.

6. Obligations of the client

The Client declares and guarantees: (i) to be of age; (ii) that the data provided by him for the execution of the Contract are correct and true.

7. Tax documentation

For each purchase TavoliSedie will always issue regular INVOICE, using the data that the Client entered in the order form or communicated by telephone to the operator.

8. Right of withdrawal (Returns)

The consumer has the right to withdraw from any distance contract, without any penalties and without specifying the reason, by 14 days from the day of the delivery at the address indicated in the order.

The consumer cannot exercise the right of withdrawal " for non-prefabricated goods produced according to an individual choice or decision of the consumer" (Directive 2011/83/EU of the European Parliament) and for " tailor-made or clearly customized goods" (art. 59 Legislative Decree 21/2014): for the great degree of customization that characterizes our collections, and for the production processes mainly to order from our suppliers, the right of withdrawal cannot be applied to the overwhelming majority of the products of our catalogue. For further information on this matter, please contact the Client Service before purchasing or in any case before the product is put into production.
